This is a convenience translation of the German original. The German version of this legal notice is authoritative for its interpretation. This does not deprive you of the protection afforded by mandatory provisions of the law of the country in which you have your habitual residence.

Who this version is for. The English set of legal documents (this legal notice, the General Terms and Conditions, the Privacy Policy and the Right of Withdrawal notice) is the fallback version for all locales that do not resolve to German, French, Dutch, Danish or Swedish. It describes the position under EU and German law and, in the separately headed sections, under Swiss law. If you have your habitual residence outside the EU/EEA and Switzerland, the mandatory consumer protection rules of your own country continue to apply to you in addition to, and where more favourable instead of, what is set out here.

Klaimo stores content supplied by its users (for example display names, team names and profile pictures) and is to that extent a hosting service within the meaning of Regulation (EU) 2022/2065 (Digital Services Act, DSA).

• Notices of illegal content (Art. 16 DSA) should be sent to the same address or submitted through the reporting function in the App. The procedure is described in § 8 of our General Terms and Conditions.
• Languages (Art. 11 (3), Art. 12 (2) DSA): these contact points accept communication in German and English. Authorities and users may therefore address us in either of those two languages.

Paid Klaimo Pro subscriptions are not sold by us. They are concluded with, and billed by, the operator of the app store you use, acting as seller (merchant of record):

Consumer dispute resolution

We do not participate voluntarily in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle), and we are not obliged to do so. We also employ ten people or fewer, so the general duty of information under § 36 (1) no. 1 Verbraucherstreitbeilegungsgesetz (VSBG – German Act on Alternative Dispute Resolution in Consumer Matters) does not apply to us.

That exemption does not, however, release us from § 37 VSBG, which applies without any size threshold: if a specific dispute between you and us cannot be settled directly, we will point you in text form to the consumer arbitration board that is competent for it, giving its address and website, and tell you whether we are willing to participate in proceedings before it. Our statement above concerns only our own willingness to participate in voluntary proceedings. It does not oust the statutory jurisdiction of a consumer dispute resolution body that your national law makes competent irrespective of our participation, and you remain free to address such a body.

Liability for content

As a service provider, we are responsible for our own content on these pages under the general laws in accordance with § 7 (1) DDG. However, pursuant to §§ 8 to 10 DDG, we are not obliged as a service provider to monitor transmitted or stored third-party information or to investigate circumstances that indicate unlawful activity. Obligations to remove or block the use of information under the general laws remain unaffected.

Liability for links

Our offering contains links to external third-party websites over whose content we have no influence. We therefore cannot accept any responsibility for this third-party content. The respective provider or operator of the linked pages is always responsible for their content.
